Introduction

  1. Betweenity (Pty) Ltd (Betweenity, us, our or we) is a South African company providing products and services in the area of competition law, economics and policy.
  1. In South Africa, the Protection of Personal Information Act, 4 of 2013 (POPIA) applies to the processing of personal information by responsible parties.
  1. This Privacy Notice forms part of the Terms and Conditions of Use of:
    • the Betweenity websites, which are betweenity.online and betweenity.site (collectively referred to as the Betweenity Website);
    • the online Betweenity Tool (Betweenity Tool); and
    • the Betweenity Application.
  1. The Betweenity Tool and the Betweenity Application is collectively referred to as the Betweenity Platform.
  1. This Privacy Notice is binding on everyone who chooses to access the Betweenity Website or the Betweenity Platform without qualification or exception. By using the Betweenity Website or the Betweenity Platform, the person accessing the Betweenity Website and the Betweenity Platform (User) agrees to be bound by the Platform Terms and this Privacy Notice, and acknowledges that the User has read and understood them. If the User does not agree to any of the Platform Terms, including this Privacy Notice, the User should not enter, view or make use of the Betweenity Website or the Betweenity Platform.

Betweenity Website

  1. When visiting the Betweenity Website, no personal information is collected.
  1. When submitting a contact form, the following personal information is collected:
    • your name and surname;
    • your company name;
    • your position;
    • your e-mail address;
    • your mobile number;
    • your city name; and
    • your country name.

Betweenity Application

  1. When downloading the Betweenity Application, no information is collected.
  1. When registering as a non-subscriber on the Betweenity Application, the following personal information is collected:
    • your name; and
    • your e-mail address.
  1. When we register you as a subscriber on the Betweenity Application, the following personal information is collected:
    • your name and surname;
    • your company name; and
    • your e-mail address.

Betweenity Tool

  1. When we register you as a subscriber on the Betweenity Tool, the following personal information is collected:
    • your name and surname;
    • your company name; and
    • your e-mail address.

Our use of your personal information

  1. Only authorised representatives of Betweenity shall have access to the personal information we hold on you.
  1. We may process your personal information:
    • for the performance of the products and services that we render;
    • to enable us to comply with an obligation imposed by law; and
    • if it is necessary for pursuing our legitimate interests.
  1. We will retain your personal information for as long as you are a User of Betweenity and for a period thereafter in accordance with the provisions of POPIA.
  1. The platforms used by the Betweenity App include Google Play, Apple Store, Huawei App Gallery and Endurance International Group.
  1. We may provide you with news updates and marketing materials in your capacity as a Betweenity User. However, you will always be able to unsubscribe from marketing communications.
  1. The Betweenity Application is not directed at persons under the age of 18. We do not knowingly collect personal information from persons under the age of 18. If you are a parent or guardian of a child under the age of 18 and become aware that your child has provided her/his personal information to us, please contact us and we will take reasonable steps to remove such information.
  1. You have the right to establish whether we hold your personal information and to request access to such information as provided for in POPIA.

Accessing Information

  1. You have the right to request, where necessary, the correction, destruction or deletion of your personal information, and we may deal with such a request as set out in section 24 of POPIA.

Security

  1. Personal information is stored in a combination of paper and electronic files. Betweenity will store all the personal information you provide on our secure servers and will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.
  1. You are responsible for keeping the password you use for accessing the Betweenity Platform confidential.

  1. The Betweenity Platform contain links to information at other websites. Clicking on one of these links will take you to such other websites, whose privacy policies may differ from ours.

General

  1. Betweenity may amend this Privacy Notice from time to time. If such amendments affect the way in which Betweenity uses or discloses personal information already held by Betweenity in a material way, Betweenity will obtain consent from you.
  1. The User accepts that by using the Betweenity Website or the Betweenity Platform, the User consents to any processing or storage of the User’s personal information and warrants that any and all data provided by the User are up-to-date and accurate.
